Autonomous artificial intelligence (AI) systems can lead to unpredictable behavior causing loss or damage to individuals. Intricate questions must be resolved to establish how courts determine liability. Until recently, understanding the inner workings of “black boxes” has been exceedingly difficult; however, the use of Explainable Artificial Intelligence (XAI) would help simplify the complex problems that can occur with autonomous AI systems. In this context, this article seeks to provide technical explanations that can be given by XAI, and to show how (...) suitable explanations for liability can be reached in court. It provides an analysis of whether existing liability frameworks, in both civil and common law tort systems, with the support of XAI, can address legal concerns related to AI. Lastly, it claims their further development and adoption should allow AI liability cases to be decided under current legal and regulatory rules until new liability regimes for AI are enacted. A literatura mundial reconhece Carolina de Jesus e Clarice Lispector como escritoras reflexivas e críticas à sociedade brasileira do século XX e ao feminino. Este artigo expõe uma leitura hermenêutica inspirada em Martin Heidegger, a respeito de Quarto de Despejo e Perto do Coração Selvagem, clássico literários, entendendo-os como horizontes de encontro para compreender o feminino desde a circularidade de sentido envolvendo entes humanos e existenciais heideggerianos. A apropriação da linguagem das escritoras estreou modos de libertação do feminino, desvelamentos (...) de significados e conceções de mundo. Expor a Fenomenologia heideggeriana atenta ao feminino, acrescida da análise psicológica das escritoras, reflete suposta neutralidade histórica, cultural e literária que elege protagonistas-narradores masculinos como singulares, e segregam o feminino a relacionamentos, filiações ou proles. Os resultados, a partir da reflexão/compreensão hermenêutica, reconstroem noção de humanidade que rompe com complementaridades, por exemplo, personagens femininas que não procuram pelo masculino; que explicita noção do eu feminino que não reforça intimismo, a primeira pessoa, nesses clássicos, é uma indeterminação correspondendo aqueles à margem social. As lutas cotidianas sejam contra fome, sejam não sucumbir a acessório do masculino, fazem da hermenêutica do feminino exercício de resistência. Apropriar o humano de sua correspondência com mundo ao formular sentidos não discriminatórios possibilita e empodera o formular de reflexões e ações demonstrativas de liberdade e ética. (shrink)

Recent developments in Continental philosophy have included the emergence of a school of “speculative realism,” which rejects the human-centered orientation that has long dominated Continental thought. Proponents of speculative realism differ on several issues, but many agree on the need for an object-oriented ontology. Some speculative realists identify realism with materialism, while others accord equal reality to objects that are non-material, even fictional. Several thinkers retain a focus on difference, a well-established theme in Continental thought. This paper looks at speculative (...) realism from the perspective of systems theory. Many of the tenets of speculative realism have long been features of systems metaphysics and are expressed clearly in a systems framework. O objetivo deste estudo é apresentar uma revisão sistemática da literatura acerca da aplicação de virtudes intelectuais no contexto da prática educacional. Para o levantamento dos artigos científicos foram consultadas oito bases de dados consideradas as mais relevantes devido ao rigor científico e reconhecimento da qualidade de produção. A partir dos critérios de inclusão e exclusão foram selecionados cinco artigos científicos para serem avaliados. Nos resultados obtidos foi possível verificar a escassez de produção científica na temática, especialmente no Brasil, visto (...) que as produções, em sua maioria, são internacionais. As discussões acerca do ensino de virtudes intelectuais ainda possuem muitas divergências e lacunas, o que é normal, considerando seu pouco tempo de existência. (shrink)

A partir dessa conjectura, esse artigo visa refletir sobre a importância das competências no ensino de humanidades para a formação de cidadãos democráticos. Para isso, realizamos uma pesquisa de cunho bibliográfico, baseada no pensamento de Martha Nussbaum sobre as competências necessárias para o desenvolvimento de uma cidadania democrática (2015). O desenvolvimento de competências no ensino de humanidades promove (...) a autonomia do estudante no âmbito pessoal, profissional, intelectual e político para o enfrentamento dos desafios da sociedade. Essas competências permitem aos estudantes enfrentar a realidade e as necessidades humanas com senso crítico e consciência de sua responsabilidade como pessoa em um meio social, político e cultural. Neste artigo apresentamos uma tradução e discussão de uma carta do filósofo Leibniz (1646-1716), na qual ele discute ações para o aperfeiçoamento da medicina. A importância e atualidade desta carta consiste em propor ações públicas de controle de epidemias pelo estado, como também, discute o uso de medicação pela medicina para controle das epidemias. No primeiro momento, explicamos a importância da publicação desta carta, destinada a Germain Brice, no Journal des Savants. No segundo momento apresentamos a tradução do texto, onde (...) ele sugere a coleta de informações para ajudar na contenção da disseminação das doenças epidemiológicas. Essa é uma sugestão da qual alguns governos modernos poderiam se beneficiar. No mesmo texto, Leibniz também faz referência ao tratamento de uma pandemia com uma substância considerada estranha. The phenomenon of altruism extends from the biological realm to the human sociocultural realm. This article sketches a coherent outline of multiple types of altruism of progressively increasing scope that span these two realms and are grounded in an ever-expanding sense of “self.” Discussion of this framework notes difficulties associated with altruism at different levels. It links scientific ideas about the evolution of cooperation and about hierarchical order to perennial philosophical and religious concerns. O YouTube é um dos sites mais acessados do mundo, a plataforma conta com diversas ferramentas de interatividade e compartilhamento de informações, heranças do surgimento da Web 2.0. O cyberespaço permitiu com que questões sociais ganhassem mais visibilidade, assim como, as relações étnico-raciais, um dos principais assunto discutidos neste trabalho. Nesta perspectiva, a seguinte pesquisa se propôs a investigar o YouTube como ferramenta no auxílio aos/as estudantes enquanto fonte de informação para uma educação antirracista. Tendo em vista que, a educação (...) é um dos caminhos para combater mazelas sociais, como o racismo, o estudo tem como objetivo geral analisar a plataforma YouTube como fonte de informação educacional na promoção de uma educação antirracista nas bibliotecas escolares. Estabelece como metodologia, uma pesquisa bibliográfica com abordagem qualitativa e de natureza básica. Entende que a biblioteca escolar pode ser um espaço que promova a diversidade e uma educação mais democrática. Com isso, a plataforma YouTube, a partir de seus vídeos, é uma fonte informacional que pode auxiliar bibliotecárias/os neste sentido. Indica o levantamento de 9 canais apresentados pelo Fundo Vozes Negras do YouTube, como fonte de informação antirracista para bibliotecas escolares. Defende, a importância da utilização destes canais em ambiente escolar, por meio da amostra de vídeos definida no corpo deste trabalho. Conclui que os conteúdos aqui apresentados, mostram que as reflexões sociais, em espaços de destaque como o YouTube, são importantes para a reconstrução de uma identidade negra positiva, negada a população negra ao longo da história. The discussion of collective agency involves the reduction problem of the concept of a collective. Individualism and Cartesian internalism have long restricted orthodox theories and made them face the tension between an irreducible concept of a collective and ontological reductionism. Heterodox theories as functionalism and interpretationism reinterpret the concept of agency and accept it as realized on the level of a collective. In order to adequately explain social phenomena that have relations as their essence, in this paper we propose a (...) relational, holistic account of collective agency and argue that functionalism and interpretationism can be integrated into such an account. He was a single dad who loved to talk and always had a smile on his face. He was obsessed with anything related to his kids and attended every school activity or sporting event.In 2015, Hayden was diagnosed with stage III colon cancer. He was adamant that he didn't (...) want to share any information about his condition with his kids, waiting several months until the eve of his first surgery before breaking the news to them. Hayden made the operation seem trivial and underplayed the severity of the chemotherapy treatments that would follow. Despite whatever he was feeling, he seemed committed to maintaining his happy demeanor, which was probably an effort to convince himself and others to feel better about the situation.Hayden survived his first operation and rounds of chemotherapy. And, over the next several years, he chose to undergo a regimen of additional aggressive treatments, submitting to surgery after surgery, as well as several more rounds of chemotherapy, followed by radiation treatments. I was already working as a home care aide, and because of the close relationship between our families, Hayden asked me to help as his caregiver, including running errands and babysitting for his younger kids. Hayden made it clear that he wanted his kids to remain ignorant of the progression of his condition so that they wouldn't worry and become anxious. It seemed he was motivated by his desire to preserve his young kids' happiness and innocence. In hindsight, I think this prevented his kids from being able to fully savor moments with their dad or prepare for the possibility of his death. I also think Hayden was trying to shelter himself from his own fear of mortality. And it was this fear that made Hayden a "difficult patient."Hayden suffered both physically and mentally, not only from his disease and treatment but also from his fear of mortality. I noticed how he tried to hide his suffering by shutting himself in his bedroom and making excuses when he wasn't eating. He often forgot to take his medications; he refused to use pill boxes and objected to reminders from others. The consequences often meant additional hospitalizations. I wish more palliative options had been introduced to him earlier in his disease course. I believe a palliative care team would have encouraged Hayden to think about and discuss death, helped him change his outlook for treatment and living with cancer, and most importantly, enabled him to better enjoy the remainder of his life with his kids.Nevertheless, I understood why Hayden was worried about his kids, and I could see how his recent personal experiences since his initial diagnosis might have contributed to his choice for the most aggressive treatments: his sister and both his parents had died, leaving no other relatives to care for his kids. He wanted to be there for his kids, yet the side effects of treatment made him so sick that he couldn't leave his bed. He couldn't even do the very activities that made him want to live.Hayden was an extremely social person, but when he found out his cancer was terminal, he [End Page E6] isolated himself from his loved ones for nearly six weeks. Even though I was likely the only person he was communicating with, as the person who helped him and his family, I often didn't see him for weeks at a time. Moral luck is a puzzling aspect of our psychology: Why do we punish outcomes that were not intended (i.e. accidents)? Prevailing psychological accounts of moral luck characterize it as an accident or error, stemming either from a re‐evaluation of the agent's mental state or from negative affect aroused by the bad outcome itself. While these models have strong evidence in their favor, neither can account for the unique influence of accidental outcomes on punishment judgments, compared with other categories of moral (...) judgment. Why might punishment be particularly sensitive to moral luck? We suggest that such sensitivity is easily understood from the broader perspective of punishment's ultimate adaptive goal: Changing others’ behavior by exploiting their capacity to learn. This pedagogical perspective accounts for the exceptional influence of outcomes on punitive sentiments and makes predictions for additional moderators of punishment. We review evidence supporting the pedagogical hypothesis of punishment and discuss fruitful directions for future research. (shrink)

Este artigo se propõe a analisar o primeiro estágio do desenvolvimento da área de pesquisa em filosofia da psicanálise no Brasil, apresentando e descrevendo os trabalhos fundadores de seus pioneiros, produzidos entre a segunda metade dos anos 1970 e o início dos anos 1990. A seguir, ele discute e procura elucidar a ideia de uma “epistemologia da psicanálise” que domina este período inicial, propondo um conjunto de quatro argumentos para proporcionar uma visão mais sistemática de suas principais teses, a saber, (...) os argumentos analítico, defensivo, conciliatório e indutor. Como conclusão, é apontada a pesquisa que ainda é necessária para se obter um panorama mais abrangente deste movimento da história intelectual brasileira. (shrink)

Recently there has been interest in examining how language is involved in the phenomenon of ‘manipulation’. This paper suggests that investigators, rather than treating ‘manipulation’ as an entity, should examine how communicators might engage in discursive acts of manipulating. To this end a distinction is made between manipulating information and manipulating people. Examples of both types, taken from the Portuguese Parliamentary Celebration of the April Revolution of 2004, are examined in depth to show how acts of manipulating can be performed (...) in different ways. By focussing on acts, we show that supposed ‘cognitive control’ over the audience's minds is not necessarily involved in manipulating; it is shown how investigators can provide evidence that manipulators act ‘knowingly’ when they mislead. We argue that the study of manipulating, and the distinction between manipulating information and people, provides a critical approach to the topic of political oratory. (shrink)

Portugal ranks fourth among countries with the highest rate of overweight population, considering that 67.6% of the Portuguese population over the age of 15 is overweight or obese. To our knowledge, limited studies have investigated students’ attitudes toward physical education in Portugal. Such research is necessary because it can provide valuable insights for policy and application in the curriculum development for physical education, which may eventually increase participation in physical and sports activities. This study analyzed students’ attitudes toward physical education (...) (PE) according to sociodemographic variables, including grade level, socioeconomic status, and gender, and their participation in extracurricular sports activities and respective PE grades. The sample comprised 476 high school students (from the 7th, 8th, and 9th-grade levels) from five public schools located in Portugal. The Students’ Attitudes toward Physical Education Questionnaire was adapted and validated for use with Portuguese students as a two-factor model. Findings show that students generally have a moderately positive attitude toward PE. However, students’ positive attitudes tend to decrease throughout high school, which is particularly significant in the 9th grade. Furthermore, students’ attitudes are influenced by gender, extracurricular sports practice, and grades. These findings may help stakeholders reflect on how to frame PE in a more meaningful way to create a solid foundation for maintaining an active lifestyle throughout life. Assim, objetivamos mostrar a posiçáo de Putnam frente a questáo fato e valor tambem conhecida por Sein (ser) e Solen (Dever (...) ser], procurando tecer algumas considerações a respeito do seu ponto de vista, pretendendo, por fim, mostrar que a ideia defendida por este filosofo é a de que náo existe uma separaçáo absoluta entre fato e valor. Este artigo apresenta a potência do pensamento da filósofa e professora Ada Kroef para o ensino de Filosofia e a Educação. Para tanto, abordaremos os livros Currículo-nômade: sobrevoos de bruxas e travessias de piratas Inspirada pela Filosofia da Diferença (2018) e Escola como polo cultural: contornos mutantes em fronteiras fixas (2017). Nessas obras, a autora questiona teorias e práticas conservadoras do ensino e da educação de forma geral, propondo a criação de novas práticas e posicionamentos teóricos. A estrutura desse artigo (...) se desenvolve em dois tópicos. O primeiro, A Escola na Filosofia, pensa essa instituição a partir das noções de currículo-nômade e currículo-programa. How do people excluded from political life achieve political agency? Through a series of historical events that have been mostly overlooked by political theorists, Martin Breaugh identifies fleeting yet decisive instances of emancipation in which people took it upon themselves to become political subjects. Emerging during the Roman plebs's first secession in 494 BCE, the _plebeian experience_ consists of an underground or unexplored configuration of political strategies to obtain political freedom. The people reject domination through political praxis and concerted action, (...) therefore establishing an alternative form of power. Breaugh's study concludes in the nineteenth century and integrates ideas from sociology, philosophy, history, and political science. Organized around diverse case studies, his work undertakes exercises in political theory to show how concepts provide a different understanding of the meaning of historical events and our political present. _The Plebeian Experience_ describes a recurring phenomenon that clarifies struggles for emancipation throughout history, expanding research into the political agency of the many and shedding light on the richness of radical democratic struggles from ancient Rome to Occupy Wall Street and beyond. Much insect sounding is beyond the limits of typical human hearing ability. This sonic separation is exacerbated by a socialized narrative of fear and avoidance of insects in many western societies. With the use of audio technologies to expand our senses, we can embrace opportunities to get to know sensory and communicative insect sound-worlds beyond our own. Ecological sound art – sound art that has an environmentalist intent – is a tangible and accessible means of listening to these sounds. In (...) the series Built Hidden Soundscapes, the primary author (Schonberg) composes imagined soundscapes existing solely of sounds that are beyond the limits of typical human hearing ability. In this article we introduce two compositions in this series, Reserva Florestal Adolpho Ducke and Pipeline Road. These compositions offer a temporary expansion of our aural senses that can increase listeners’ awareness of cryptic insect existences/ecologies. We suggest that this listening practice might prompt future auralization (sounding or hearing in the mind) of insect sound for the listener. (shrink)

The aim of this study was to analyze the association between coaches’ experience and their perceptions on the implementation of a long-term athletic development model created in 2016 by the Portuguese Swimming Federation. Eighty-six swimming coaches were assembled in groups according to their experience level: “novice”, “intermediate”, and “experienced”, and they answered a questionnaire with the following items: awareness of the existing model acceptance usefulness for practice, and implementation of this model by their peers. Regardless of experience, ~67% of the (...) coaches were aware of the model. Among those, a large number showed acceptance and confidence in its usefulness for their daily practice. Most coaches showed concerns about the fact that their peers do not respect the model frameworks, declaring the search for their swimmers’ immediate success as the main cause for such behavior. The results also showed an association between experience and knowledge about the model’s existence [χ2 = 10.223, p < 0.01, V = 0.345], and experienced coaches exhibited better knowledge than their intermediate [χ2 = 9.555, p < 0.01, V = 0.393] or novice [χ2 = 5.926, p = 0.02, V = 0.314] counterparts. While there was an association between the coaches’ experience and knowledge about the LTAD model’s existence, this situation does not seem to influence the way coaches accept and understand the usefulness of the model for their daily practice.
